August 11, 2000 – Evergreen Freedom Foundation files notice of violation with Attorney General.

September 25, 2000 – Public Disclosure Commission investigates; refers case to AG for prosecution.

October 9, 2000 – Attorney General files suit against Washington Education Association.

March 2001 – Teacher class action filed in Thurston County Superior Court.

July 31, 2001 – Thurston County Superior Court rules WEA guilty of “multiple violations.”

November 2001 – Thurston County Superior Court certifies teacher class action, decided for teachers on private right of action.

June 24, 2003 – Court of Appeals, Div. II, consolidates WEA case with teacher class action, rules 2-1 that law is unconstitutional.

May 27, 2004 – Washington Supreme Court oral arguments.

March 16, 2006 – Washington Supreme Court upholds Court of Appeals decision 6-3.

June 14, 2006 – Washington Attorney General and Davenport file writ of certiorari petitions with U.S. Supreme Court.

September 26, 2006 – U.S. Supreme Court grants review of cases.

November 8, 2006 – Merit briefs submitted
