On January 10, the United States Supreme Court will hear oral arguments in two landmark First Amendment cases from Washington State: Washington v. Washington Education Association and Davenport v. Washington Education Association. The cases stem from a decade’s worth of work by concerned teachers and the Evergreen Freedom Foundation, a Washington state think tank, and it could affect millions of union-represented workers nationwide. At issue is the union’s use of mandatory dues for politics without first getting teachers’ permission. The Court will decide, once and for all, whose free speech rights are paramount: The individual, whose inalienable rights are protected by the Constitution or union organizations, given a limited authority to collect dues under state laws.
